Terms of Service | Pitch Craft Empire

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Pitch Craft Intelligence LLC, an Illinois limited liability company ("Pitch Craft Empire", "we", "us"). By accessing the website at pitchcraftempire.com or any related products (the "Services"), you agree to these Terms. If you do not agree, do not use the Services.

2. The Services

The Services include AI-generated pitch assistance, a roster of automated "agents", AI-synthesized voice playback (including the "Cheresha" voice powered by third-party text-to-speech providers), demos, and related tooling. Functionality may evolve, be added, or be removed at our discretion.

3. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for safeguarding any credentials and for all activity under your account. Notify us at deckstrategy@atlassian.net of any unauthorized use.

4. Acceptable Use

You agree not to:

Use the Services for unlawful, deceptive, or harmful purposes.
Generate or distribute content that impersonates a real person without consent, including via cloned or synthesized voices.
Reverse-engineer, scrape, or attempt to extract underlying models, prompts, or training data.
Resell, sublicense, or use the Services to build a competing product.
Upload malware or interfere with the integrity of the Services.

5. AI Output Disclaimer

Outputs are generated by machine learning models and may be inaccurate, incomplete, or unsuitable. You are solely responsible for reviewing and validating any output before relying on, publishing, or sending it. The Services do not provide legal, financial, medical, or investment advice.

6. Customer Content

You retain ownership of content you submit ("Customer Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and transmit Customer Content solely to operate and improve the Services. You represent that you have all rights necessary to submit such content.

7. Fees & Billing

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change pricing on notice; changes apply to subsequent renewal terms. Taxes are your responsibility.

8. Intellectual Property

We and our licensors retain all right, title, and interest in the Services, including software, models, voices, branding, and the "Cheresha" persona. No rights are granted except as expressly set out in these Terms.

9. Third-Party Services

The Services rely on third-party providers (e.g., ElevenLabs for voice synthesis, hosting and analytics vendors). Your use of those features is also subject to the relevant third-party terms.

10. Termination

We may suspend or terminate access at any time for breach of these Terms or to protect the Services. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA.

13. Indemnification

You will defend, indemnify, and hold harmless Pitch Craft Intelligence LLC from any claims arising out of (a) your Customer Content, (b) your use of the Services in violation of these Terms or law, or (c) outputs you publish or distribute.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in Cook County, Illinois, and the parties consent to personal jurisdiction there.

15. Changes

We may update these Terms from time to time. Material changes will be announced on the Services. Continued use after changes constitutes acceptance.
